Information notice pursuant to article 13 of the Legislative Decree No. 196/03
Pursuant to and under the provisions of the Legislative Decree No. 196 of 30 June 2003 (Personal Data protection Code), you are hereby informed that the personal data you voluntarily made available will be processed in compliance with the regulations on personal data protection currently in force and, in any case, with the principles of confidentiality adopted by the Company:
- Purposes of the processing
The personal data you supplied to Diadora S.p.A. may be used for the following purposes: (a) to allow and manage your sign up/registration to the Site, (b) for the management and execution of your orders and/or purchase proposals of our products and/or the supply of services relevant to the sale and/or services reserved to registered users such as publishing reviews and comments from registered users by the proper online forms; (c) to transmit information and business communication, including those of a promotional nature (including our newsletter), advertising material and/or offers of products, through any means whatsoever (whether known or unknown), including, but not limited to, mail, Internet, telephone, E-mail, MMS, SMS, (d) to allow the processing and completion by Diadora S.p.A. of market and statistical studies and research, as well as for the purpose of analysing tastes, preferences, habits, needs and consumptions
- Processing arrangements
Your personal data will be processed by means of appropriate paper, electronic and/or telematic means, according to rationales strictly related to the purposes referred to above and, in any case, so as to ensure the safety and confidentiality of such data.
- Data supply and consequences of a possible refusal to supply them
With reference to the purposes specified in paragraph 1, letters (a) and (b) above, the supply of your personal data is mandatory. If you refuse to supply such data and/or if you supply inaccurate and/or incomplete information, this may make it impossible:
- for you to sign up/register to the Site;
- to manage and execute your purchase orders and/or proposals concerning goods and/or the provision of sale-related services.
With reference to the additional purpose specified in paragraph 1, letters (a) and (d) above, the supply of your personal data is optional. However, should you refuse to supply such data and/or if you supply inaccurate and/or incomplete information, this may prevent:
- the performance of the so called marketing activities;
- the performance of the so called profiling activities;
- Location where data are processed and disclosure of data
Any processing activity related to the web services of this site is performed at the registered office of Diadora S.p.A. mentioned above by internal staff specifically appointed with the processing of the data, and at the offices of the partners selected for the delivery of the service, specifically appointed as external data controllers.
No data resulting from the web service is notified or disclosed, but it may be transferred to third parties, through the data controllers mentioned above, also outside of the European Union, for the performance of specific activities (payment management, logistics, computer services).
- Rights of the data subject
With reference to the aforementioned processing activities, you may exercise the rights provided for in article 7 of the Legislative Decree No. 196 of 30 June 2003, by transmitting a specific written request to the email address email@example.com, to the kind attention of the Data Processor. For your convenience, article 7 of the Legislative Decree 196 of 30 June 2003 is copied below in its entirety
ARTICLE 7 - RIGHT TO ACCESS PERSONAL DATA AND OTHER RIGHTS
1. The data subject is entitled to receive confirmation of the existence of personal data related to him/her, even if they have not been registered yet, and to obtain the communication thereof in an intelligible form.
2. The data subject is entitled to receive information on:
a) the source of the personal data;
b) purposes and procedure of the data processing;
c) the rationale applied in case of processing through electronic means;
d) the identification data of the data controller, data processors and of the representative designated pursuant to article 5, sub 2;
e) the persons and categories of persons to which the personal data may be disclosed or that may become aware of them as representatives designated in the territory of the State, data controllers or data processors.
3. The data subject is entitled to obtain:
a) that the data be updated, rectified or, where he/she so desires, supplemented;
b) the cancellation, transformation in an anonymous form or the block of the data processed in breach of the law, including c) those for which the data has been gathered or subsequently processed;
the certification of the fact that the activities referred in letters a) and b) above have been disclosed, also as regards the contents thereof, to those to whom the data was communicated or disseminated, except where this proves to be impossible or requires a clearly disproportionate effort compared to the right protected.
4. The data subject has the right to object, in whole or in part:
a) for legitimate reasons, to the processing of his/her personal data, even if relevant to the purpose of the collection thereof;
b) to the processing of his/her personal data for the purpose of forwarding advertising material of for direct sale activities or for market research or business communications.
