Purposes and legal basis of the processing

The Controller processes your data for various purposes:

  1. respond to requests forwarded through this form, including to obtain information on its products or services (including the sending of brochures, catalogues and/or other corporate information material), to obtain a quote, etc.: in this case, the consent is not required because the processing is necessary to comply with these requests;
  2. use the Data Subject’s contact information (e-mail address, home and mobile phone number, postal address) to carry out satisfaction surveys and opinion polls, send commercial communications containing information about its products or services, as well as promotions or invitations to events in which the Controller will participate: for this purpose, the express consent of the Data Subject is required. The Data Subject’ consent may be granted and revoked for some of the aforementioned activities only.


Data storage period

The Controller intends to process the data during the following storage period:

  1. the storage period in relation to your requests for information will be three months from the reply;
  2. the data provided to enable the Controller to send the commercial communications described above will be kept for 24 months from the last communication, regardless of the channel used;

Mandatory or optional disclosure of data and consequences of the refusal of consent

The provision of data for the purposes referred to in point 1) above is necessary; therefore, any refusal to supply it, whether in whole or in part, may result in the Controller being unable to pursue the above mentioned purposes. The disclosure of your data is optional for the other purposes: where no data is supplied, the Controller will not be able to carry out the corresponding activities but will, in any case, be entitled to pursue the purposes referred to in point 1) above.

Categories of recipients

The Controller will not disseminate your data, although it intends to disclose it to its personnel authorised to carry out the processing as part of their respective duties, as well as Group companies, professionals or service companies, commercial agents and public and private bodies, including following inspections and audits.

In order to be tasked with processing your data on behalf of the Controller, those recipients will be appointed as data processors under a specific agreement or other legal document.


Transfer of data to a third country and/or an international organisation

The data will not be transferred to third non-EU countries nor to international organisations.

Data subjects’ rights

The Data Subject may request from the Controller access to and rectification, where inaccurate, or erasure of his/her personal data and restriction of the data processing, where the relevant conditions are met; he/she may also object to the processing for legitimate interests pursued by the Controller and obtain the portability of personally provided data only if this is subject to automated processing based on consent or contract. Moreover, the Data Subject may withdraw his/her consent when this is necessary to pursue the processing purposes. In this case, however, the withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal.

Only for the purposes specified above, all data collected and processed may be disclosed by Diadora and Diana to internal persons authorised to process data by virtue of their duties, as well as to the following categories of external persons as independent controllers or external processors:

  • IT service providers, such as direct marketing, internet service and cloud computing;
  • persons who perform logistics, warehousing, promotion, supply, sale and delivery of products and services of the Joint Data Controllers;
  • persons who perform customer service activities;
  • professional firms and other persons who provide assistance, consultancy and services regarding, for example, legal, tax, accounting, financial, technical-organisation, data processing and disclosure;
  • persons that provide banking, financial, insurance and debt collection services;
  • subsidiaries, parent companies, investee companies or affiliates;
  • public authorities and supervisory and control bodies;
  • third-party companies in the context of acquisitions or disposals of the company or a business unit.

Should these recipients process data on behalf of Diadora and Diana, they shall be appointed data processors under a contract or other legal instrument.

No data collected on the Website is subject to dissemination.



The Website and the related services are not dedicated to minors and, therefore, Diana and Diadora do not knowingly collect personal data online of persons aged under 18.



Your personal data may be transferred, for the same purposes for which they are collected, to the United States of America (USA), which is a country outside the European Union.

The transfer of personal data to entities located in the USA will take place exclusively by virtue of the signing with the non-EU recipient of the standard contractual clauses approved or adopted by the European Commission (Article 46(2)(c) and (d) of the GDPR) or in any case entities registered to the Privacy Shield, a self-certification mechanism for the companies located in USA which intend to receive personal data from European Union according to the implementing decision (EU) 2016/1250 adopted by the European Commission on 12 July 2016.

Data subjects have the right to ask Diana and Diadora for access to their personal data and to amend them if inaccurate, to erase them or to limit the processing if the conditions are met, to object to their processing for interests of Diana and Diadora and to obtain the portability of the data personally provided only if subject to processing by automated means based on consent or contract. Data subjects have the right to withdraw the consent provided for the processing purposes for which it is necessary, without prejudice to the lawfulness of the processing executed until the withdrawal.
